THE LEGAL PROCESS OF BUYING AND TRANSFERING LAND IN KENYA

Land Identification & Search

Identify if the land is residential, commercial or both & if suits your interests

Secure copy of the title deed of the land, ID card & KRA Pin of the seller and take to respective land registry to ascertain the acreage and original owner.

Obtain Land Rent Clearance Certificate

Determine if there are any unpaid land rates

After conducting serch,inquire if there are any unpaid land rates. If so, agree with the land seller who will settle the outstanding amounts.

Obtain Maps of the Land

Atleast 2 Maps

One map will be the mutation showing the exact measurements of the land. The other map will show an overview of the land together with those of the surrounding neighboring properties. Verify at the property together with the seller and an accredited surveyor.

Offers & Negotiations

Drafting of Sale agreement

After finishing all due diligence, the buyer makes an offer to the seller. If seller agrees, a sale agreements should be prepared by a lawyer capturing all conditions and factors like price, payment methods, mode of payment and title transfer guidelines.

Land Control Board Clearance & Valuation

Comprises of elders from the area & county commissioners

Get clearance from the Land Board, whose sole purppsoe is to ensure that any land transfer has been done legally with transparency and knowledge of the community after which you will receive a Land Control Board Consent Form.

Payment of Stamp Duty & Registration of Transfer

Valuation

Through the land registry, submit Land Control Board Consent Form and apply for valuation. This will determine the stamp duty to be paid. The seller WILL SUBMIT

  3. 2 Passport size photos
  4. The old Title Deed
  5. Sale agreement

Duration of change of ownership: 3-4 weeks
